Mareva Injunctions/Norwich Orders/Anton Piller Orders in the Context of Estate Proceedings
Overview
In estate disputes, Norwich Orders and Anton Piller Orders are powerful but exceptional remedies used to obtain or preserve critical evidence, often in situations involving suspected misconduct by trustees, beneficiaries, or third parties, and typically without notice to the alleged wrongdoer. A Norwich Order compels a party, even prior to litigation, to disclose the location of impugned assets that are believed to belong to the Estate. An Anton Piller Order is a civil search order that permits a party to enter a respondent’s premises without prior notice to preserve evidence that is at risk of destruction. This seminar will discuss the high threshold needed to secure these orders and the process involved, as well as the stringent safeguards imposed for the protection of the alleged wrongdoer.
